Welcome to Joggles.com. These Terms and Conditions ("Terms") govern your access to and use of the website located at www.joggles.com (the "Site"), including any purchases made through the Site. The Site is owned and operated by Joggles.com, Inc. ("Joggles," "we," "us," or "our").

By accessing or using the Site, creating an account, or placing an order through the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site.

1. Eligibility and Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. By using the Site or placing an order, you represent that you have the legal capacity to enter into a binding agreement or are using the Site with the authorization and supervision of a parent or legal guardian.

• Use the Site for any unlawful, fraudulent, or unauthorized purpose;
• Attempt to gain unauthorized access to the Site, its servers, accounts, or related systems;

We reserve the right to suspend or terminate an account if we reasonably believe it is being used fraudulently, unlawfully, in violation of these Terms, or in a manner that may harm Joggles, our customers, or third parties.

3. Products and Product Information

We make reasonable efforts to display and describe our products accurately. However, colors, dimensions, packaging, designs, and other product characteristics may appear differently depending on your display, device, manufacturing variations, or changes made by a manufacturer.

Product photographs and illustrations are provided for informational purposes and may not always represent exact colors, scale, packaging, or appearance.

We reserve the right to modify product descriptions, correct errors, discontinue products, and change product availability at any time without notice.

4. Pricing

Prices displayed on the Site are stated in U.S. dollars unless otherwise indicated. Prices, discounts, promotions, and product availability are subject to change without notice.

We make reasonable efforts to ensure that prices and other information displayed on the Site are accurate. Occasionally, however, typographical, pricing, inventory, or other errors may occur.

If an item is listed at an incorrect price or contains incorrect information, we reserve the right to correct the error and to cancel or refuse any affected order, including an order that has already been submitted. If payment has already been collected for an order that we cancel, we will issue an appropriate refund or credit.

5. Orders

Submitting an order through the Site constitutes an offer to purchase the products in your order. Receipt of an order confirmation does not necessarily constitute our acceptance of your order.

All orders are subject to acceptance by Joggles and to product availability. We reserve the right to refuse, limit, or cancel an order for legitimate business reasons, including but not limited to:

• Product unavailability;
• Pricing, description, or inventory errors;
• Suspected fraud or unauthorized payment activity;
• Orders that appear to be intended for unauthorized resale;
• Shipping restrictions;
• Violation of these Terms; or
• Other circumstances that reasonably prevent us from fulfilling the order.

If an item becomes unavailable after an order is submitted, we may remove the unavailable item from the order and issue an appropriate credit or refund.

6. Payment

You agree to provide accurate and complete billing and payment information when placing an order.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment service providers to process the applicable charges associated with your order.

7. Sales Tax

Applicable sales, use, or similar taxes will be collected where required by law. The amount of tax charged, if any, may depend upon the products purchased, the shipping destination, and applicable tax laws.

Customers are responsible for any taxes, duties, customs charges, or other governmental fees that are not collected by Joggles but that may apply to their purchase.

8. Shipping and Delivery

Shipping methods, charges, estimated delivery times, discounted shipping offers, international shipping restrictions, customs information, and related terms are described in our Shipping Policy, which is incorporated into these Terms by reference.

Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occur due to postal or carrier delays, weather, customs processing, peak shipping periods, incorrect addresses, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional costs resulting from an incorrect or incomplete address may be the customer's responsibility to the extent permitted by law.

9. International Orders

International orders are subject to the destinations, carriers, and shipping methods currently supported by Joggles. Please review our Shipping Policy before placing an international order.

International customers are responsible for applicable customs duties, import taxes, brokerage fees, handling charges, or similar amounts imposed by their country or local authorities unless otherwise expressly stated by Joggles.

Joggles will accurately declare merchandise information and value as required by applicable law and will not falsify customs declarations, undervalue merchandise, or improperly designate merchandise as a gift or commercial sample.

10. Returns, Damaged Goods, and Store Credits

Returns, damaged products, non-returnable products, return authorization requirements, restocking fees, return deadlines, and store credits are governed by our Returns / Damages Policy, which is incorporated into these Terms by reference.

Please review that policy before making a purchase, particularly when purchasing products that may be non-returnable because of their nature or because they have been cut, opened, or otherwise made unsuitable for resale.

11. Gift Certificates and Promotional Offers

Gift certificates, coupons, promotional codes, discounts, and other promotional offers may be subject to additional terms disclosed at the time they are offered.

Unless otherwise stated, promotional offers have no cash value, may not be combined with other offers, and may be modified or discontinued at any time, subject to applicable law.

Gift certificates are subject to applicable law and any additional redemption terms provided on the Site.

By submitting User Content, you represent that you have the right to submit it and that it does not violate the rights of any third party or any applicable law.

You grant Joggles a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute User Content submitted to the Site in connection with operating, promoting, and improving Joggles and the Site.

We reserve the right, but have no obligation, to remove User Content that we reasonably consider unlawful, offensive, misleading, infringing, irrelevant, spam, or otherwise inappropriate.

Except as permitted by applicable law, you may not reproduce, distribute, modify, publish, sell, commercially exploit, or create derivative works from Site content owned by Joggles without our prior written permission.

Product names, manufacturer names, trademarks, logos, and other intellectual property owned by third parties remain the property of their respective owners. Their appearance on the Site does not imply sponsorship or endorsement except where expressly stated.

14. Craft Projects, Tutorials, and Product Use

The Site may contain tutorials, project ideas, techniques, instructions, videos, and other creative or educational material. This information is provided for general informational and inspirational purposes.

You are responsible for following manufacturer instructions and appropriate safety precautions when using paints, inks, adhesives, tools, cutting equipment, heat tools, chemicals, and other craft products.

Some products may not be suitable for children or may require adult supervision. Please review and follow all manufacturer warnings, age recommendations, safety instructions, and product labeling.

15. Third-Party Products

Many products available through the Site are manufactured by third parties. Product specifications, warnings, instructions, warranties, and representations supplied by a manufacturer remain the responsibility of that manufacturer.

Nothing in these Terms limits any rights or remedies you may have against a manufacturer or other party under applicable law.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOGGLES.COM, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF JOGGLES.COM, INC. ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO JOGGLES FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Joggles.com, Inc. and its officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Site, your material violation of these Terms, or your infringement of the rights of another person.

23. Fraud and Abuse

We reserve the right to investigate suspected fraudulent or abusive activity involving the Site, customer accounts, payment methods, promotional offers, returns, or orders.

We may refuse or cancel transactions, restrict account access, or take other reasonable steps to protect Joggles and its customers where fraud or abuse is reasonably suspected. We may also cooperate with payment providers, financial institutions, carriers, or law enforcement when appropriate and permitted by law.

24. Governing Law

These Terms and any dispute arising from or relating to these Terms, the Site, or a transaction with Joggles.com, Inc. will be governed by the laws of the State of Rhode Island, without regard to its conflict-of-law principles, except to the extent applicable federal law or another law that cannot validly be waived or displaced applies.

25. Dispute Resolution and Venue

Before commencing formal legal proceedings, you and Joggles agree to make a reasonable good-faith effort to resolve a dispute by contacting the other party and describing the nature of the dispute and the requested resolution.

Unless applicable law requires otherwise, any judicial proceeding arising from or relating to these Terms, the Site, or a transaction with Joggles shall be brought in a court of competent jurisdiction located in the State of Rhode Island, and the parties consent to the jurisdiction of those courts.

26. Changes to These Terms

We may update these Terms periodically to reflect changes to our business, the Site, our practices, or applicable legal requirements.

When we make changes, we will post the revised Terms on the Site and update the "Last Updated" date above. Changes will apply prospectively from the effective date stated in the revised Terms unless applicable law requires otherwise.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.

27. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

These Terms, together with the policies and other terms expressly incorporated into them, constitute the agreement between you and Joggles concerning your use of the Site and purchases made through it, except where additional terms are expressly agreed to in writing.

If there is a conflict between these Terms and a more specific policy or term applicable to a particular transaction, product, promotion, or service, the more specific provision will control with respect to that subject matter.
